Driving Arrests

DWI
If you are charged with driving while intoxicated and your blood/alcohol content is alleged to be .10% or higher, the judge who arraigns your case will take your license from you and suspend it pending the outcome of the case.

A lawyer can request that the judge not immediately suspend your license by asking for a 20-day stay. That would allow you to have a conditional license allowing you to drive to go to school or work pending the outcome of the case.

Driving With a Suspended License
If you fail to pay your moving violations or parking tickets your license could be suspended. If you have more than 10 suspensions on your license on 10 different dates, you could be charged with a felony. Otherwise, the charge will be a misdemeanor.

If you disagree with a ticket you have received, you should request a DMV hearing and fight the ticket. A lawyer will be able to represent you at the hearing and possibly have the ticket dismissed.
