Criminal Appeals

If you are convicted of any crime, after a guilty plea or a trial, you have a right to appeal your conviction. A notice of appeal should be filed by you or your attorney within 30 days of your sentence date. If over 30 days have passed since your sentence an attorney may be able to petition the court to allow you to file a late notice of appeal.

If you appeal your conviction and win, your conviction will be reversed. The prosecutor may have the right to bring you to trial again. However, if the appeals court decides that the evidence at trial was not sufficient to support your conviction, your conviction will be reversed and the charges dismissed.
